Freshot Terms of Use

About these terms

These terms cover your use of the Freshot app. Freshot is provided by Digitforge Ltd, registered in England and Wales (company number 17091016), Office 9489, 321-323 High Road, Chadwell Heath, Essex, United Kingdom, RM6 6AX. "We" and "us" means Digitforge Ltd.

By using Freshot you agree to these terms. If you don't agree, please don't use the app. How we handle your data is explained in the Freshot Privacy Policy.

Who can use Freshot

You must be at least 13 years old to use Freshot, or at least 16 if you live in the UK or the European Union.

Your photos and results

You keep ownership of the photos you upload. You give us permission to store and process them, and to send them to our AI image provider, only so we can create your results and show you your history.

Subject to these terms and the law, you may use your results however you like, including commercially. You are responsible for how you use them.

Acceptable use

When you use Freshot, you agree to:

  • only upload photos you own or have the right to use;
  • not upload photos of other people without their consent;
  • not upload or create anything illegal, sexually explicit, hateful, violent or harassing;
  • never upload images of children in any sexual or harmful context;
  • not use results to impersonate someone, mislead people or pass off a generated image as a real event;
  • not infringe anyone's copyright, trademark or other rights;
  • not try to break, overload, reverse engineer or get around the limits of the app.

We may remove content and suspend or close accounts that break these rules, and report illegal content to the authorities.

AI results may vary

Results are created by AI. Each one is a new interpretation of your photo, so it may differ from what you expected, change details, or not look exactly like the people or objects in the original. Check a result before you use or share it.

Credits and subscriptions

Some features use credits. You can get credits through a subscription or by buying them in the app. The app shows what each plan includes, and how many credits a style uses, before you buy.

All purchases are made through Apple's App Store and are billed by Apple under Apple's terms. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel a subscription in your iPhone's Settings, under your name, then Subscriptions.

Refunds are handled by Apple. You can request one at reportaproblem.apple.com.

Credits have no cash value and can't be transferred, sold or exchanged. Use Restore purchases in the app's settings to get your purchases back on a new device.

Availability and changes

We work to keep Freshot running well, but we can't guarantee it will always be available, uninterrupted or free of errors. We may change, add or remove styles and features, and we may stop offering Freshot. If we stop the service, we will give you reasonable notice where we can.

Our app

The Freshot app, its design, styles and software belong to us or our licensors. These terms give you a personal, non-transferable right to use the app; they don't give you any other rights in it.

Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Nothing in these terms affects your legal rights as a consumer.

Otherwise, we are not liable for losses that were not foreseeable, for business losses, or for losses caused by how you use your results. Our total liability to you is limited to the amount you paid for Freshot in the 12 months before the claim.

Ending your use

You can stop using Freshot and delete your account at any time from the app's settings. We may suspend or end your access if you seriously or repeatedly break these terms.

Apple

These terms are between you and us, not Apple. Apple is not responsible for Freshot or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland, Northern Ireland or the European Union, you can also bring proceedings in your local courts.

Changes to these terms

We may update these terms. We will change the date below, and if the change is significant we will tell you in the app before it applies.
