Freshot Privacy Policy

Last updated

The short version

Freshot turns photos you choose into new images. To do that, the photos you pick are uploaded to our servers and sent to our AI image provider to create the result. We don't use your photos to train AI models, we don't sell them, and we don't track you across other companies' apps or websites.

You can delete any photo, your history or your whole account from inside the app at any time.

Who we are

Freshot is made by Digitforge Ltd, a company registered in England and Wales (company number 17091016), registered office Office 9489, 321-323 High Road, Chadwell Heath, Essex, United Kingdom, RM6 6AX.

Digitforge Ltd is the data controller for the personal data described in this policy. You can contact us about anything in it at business@digitforgelimited.com.

What we collect

  • Photos you choose to process. Only the photos you take in the app or pick yourself. Freshot does not scan or upload the rest of your photo library.
  • Results. The images Freshot creates from your photos, and the history of versions for each photo.
  • Account information. A basic account identifier and, if you sign in, the email address or Apple ID details you share with us.
  • Purchase information. What you bought, your subscription status and your credit balance. Payments are handled by Apple, and purchases are managed through RevenueCat. We never see your card details.
  • Diagnostics and usage analytics. Crash reports, performance data, device model, iOS and app version, and which features are used, collected through Google Firebase. We use this to fix problems and improve the app.

What we don't collect

  • Your contacts.
  • Your location.
  • Data used to track you across other companies' apps and websites. Freshot does not use the advertising identifier and does not ask for permission to track you.

How your photos are processed

When you pick a photo and a style, the photo is uploaded over an encrypted connection to our backend, which runs on Google Firebase (Google Cloud).

From there it is sent to our AI image provider, BytePlus ModelArk, only to generate your result. The result comes back to our backend and then to your device.

We do not use your photos or results to train AI models. We never sell your photos, your results or any other personal data.

Why we use your data

Under UK and EU data protection law we need a legal basis for each use of your data:

  • To provide the app: processing your photos, storing your results and history, managing your account and credits. Basis: performing our contract with you.
  • To keep the app working and secure: crash reports, diagnostics and abuse prevention. Basis: our legitimate interest in running a reliable, safe service.
  • To understand how the app is used so we can improve it: usage analytics. Basis: our legitimate interests, or your consent where the law requires it.
  • To keep records of purchases. Basis: our legal obligations, for example accounting and tax.

Who we share data with

We share data only with the service providers that run parts of Freshot for us, and only what they need:

  • Google (Firebase): hosting, storage, sign-in, crash reporting and analytics.
  • BytePlus (ModelArk): generating images from your photos.
  • Apple: payments, subscriptions and, if you use it, Sign in with Apple.
  • RevenueCat: managing purchases, subscriptions and credits.

Some of these providers process data outside the UK and the European Economic Area. Where they do, we rely on safeguards recognised by UK and EU law, such as the UK International Data Transfer Agreement or the EU Standard Contractual Clauses.

We may also disclose data if the law requires it, for example in response to a valid request from a court or the police.

Storage and retention

Your photos, results and history are stored so you can see every version of a photo and redo it later.

We keep them {RETENTION_PERIOD}, or until you delete them, whichever comes first.

When you delete your account, we delete your photos, results, history and account information from our systems within 30 days. Diagnostics and analytics data is kept for no longer than 14 months. Purchase records are kept for as long as the law requires, usually six years.

Deleting your data

You don't need to ask us to delete things. You can do it yourself in the app:

  • One photo or version: open it and tap Delete.
  • Your whole history: go to Settings and tap Delete history.
  • Your account and everything in it: go to Settings, then Account, and tap Delete account.

You can also email business@digitforgelimited.com from the email address linked to your account and ask us to delete your data. We will confirm once it's done, within one month at the latest.

Deleting your account does not cancel an App Store subscription. Cancel it in your iPhone's Settings, under your name, then Subscriptions.

Security

Photos and results are sent over encrypted connections and stored with access limited to the systems that need them. No system is perfectly secure, but we take reasonable technical and organisational measures to protect your data.

Children

Freshot is not directed at children under 13, or under 16 in the UK and the European Union. We do not knowingly collect personal data from children under these ages.

If you think a child has used Freshot and shared personal data with us, email business@digitforgelimited.com and we will delete it.

Your rights

Under the UK GDPR and the EU GDPR you have the right to:

  • access the personal data we hold about you and get a copy of it;
  • have inaccurate data corrected;
  • have your data deleted;
  • restrict or object to how we use your data;
  • receive your data in a portable format;
  • withdraw consent at any time, where we rely on consent.

To use any of these rights, email business@digitforgelimited.com. We will reply within one month.

If you are unhappy with how we handle your data, you can complain to the Information Commissioner's Office (ico.org.uk) or to the data protection authority where you live. We'd appreciate the chance to sort it out with you first.

Changes to this policy

If we change this policy, we will update the date below. If the change is significant, we will also tell you in the app before it takes effect.
